Terms of Service

1. General Provisions

These Terms of Service (hereinafter referred to as the “Terms” or “Agreement”) set out the principles and conditions for using the online service available at [gttd.automate.travel] (hereinafter the “Service”).

The owner and administrator of the Service (hereinafter the “Administrator”) is:

The Administrator can be contacted:

By starting to use the Service (including registering an Account), the User (hereinafter also referred to as the “Client”) agrees to these Terms. If the User does not accept any of the provisions of these Terms, they should cease using the Service.

The Service enables Users, among other things, to:

  • log in and view their own products (e.g., trips, attractions),
  • make use of other functionalities made available by the Administrator.

These Terms have been prepared based on Polish law, including the provisions of the Civil Code and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

The Administrator reserves the right to further expand the functionalities of the Service, as well as to amend these Terms, in accordance with the principles indicated in Section 9 below.

2. Glossary (Definitions)

  • Administrator: Etours sp. z o.o., with its registered office in Warsaw, ul. Hoża 86/410, 00-682 Warsaw, registered in the Register of Entrepreneurs (KRS) under number 0001077138, NIP PL7011180825.
  • Service: The online service available at gttd.automate.travel, enabling Users to log in, manage their own products (trips, attractions), and use other available features.
  • User / Client: Any natural person, legal entity, or other organizational unit that uses the Service to view or publish Content.
  • Account: The individual profile created by the User on the Service, allowing the User to utilize the available functionalities.
  • Content: Any materials posted in the Service by the User, including texts, graphics, photos, videos, trademarks (logos), etc.
  • Partners: Entities cooperating with the Administrator to promote or display Users’ Content (e.g., external operators such as Google).
  • Terms / Agreement: This document, together with any future amendments, setting out the rules for using the Service.
  • Contract: The contract for the provision of electronic services concluded between the Administrator and the User when the User accepts these Terms.
  • License: A non-exclusive, unlimited in territorial scope, free-of-charge, and sub-licensable consent granted by the User for the Administrator and its Partners to use the User’s Content for purposes related to the operation and promotion of the Service.

3. User Accounts

  • Registering an Account on the Service may require providing the User’s basic data (e.g., email address, password). The User guarantees that all data submitted during registration is truthful, accurate, and up to date.
  • The User is obliged to keep their login credentials confidential. All actions performed on the User’s Account are deemed to be performed by that User. If there is any suspicion of unauthorized use of the Account, the User should immediately contact the Administrator.
  • The Administrator may suspend or delete the User’s Account if it is found that the User is violating legal regulations, the provisions of these Terms, or in other justified situations (e.g., actions contrary to good morals or harming the Service’s reputation).
  • The User declares that they have full legal capacity (i.e., they are at least 18 years old) or that they are using the Service with the consent and under the supervision of a legal guardian (if permitted by applicable law).

4. Use of the Service

  • Currently, the use of the Service is free of charge. The Administrator does not rule out the possibility of introducing fees in the future. The Administrator will inform Users at least 30 days in advance of any planned changes.
  • Continued use of the Service after the effective date of the changes (including any introduced fees) will indicate acceptance of the modifications.
  • By creating an Account on the Service, the User may (subject to separate consent, if required) receive commercial information and newsletters from the Administrator. The User may unsubscribe at any time by contacting the Administrator via email ([email protected]) or by using the appropriate link in the email message, if one is provided.
  • The User undertakes to use the Service in accordance with the law, good morals, and social norms, and in particular not to post Content that is unlawful, offensive, violates the rights of third parties, or breaches data protection regulations.

5. User Content and Materials

  • The User is solely responsible for all Content published in the Service and declares that they have the relevant copyright or licenses required for publication, and that the posting of Content on the Service does not infringe the rights of third parties.
  • The User acknowledges that by publishing Content on the Service, they grant the Administrator and its Partners a non-exclusive, free-of-charge, unlimited (in terms of time and territory) License to use the Content to the extent necessary to operate and promote the Service (e.g., displaying offers, running partner programs, marketing activities).
  • The Administrator reserves the right (but is not obligated) to moderate, edit, or remove Content that it deems to be in violation of the law, these Terms, or good morals, as well as in cases where an official notice of the illegal nature of the Content has been received.
  • The License for the Content does not expire upon the deletion of the User’s Account or the termination of the Contract, unless otherwise agreed with the Administrator.

6. Personal Data Administrator (GDPR)

Personal data is processed for the following purposes:

  • Allowing the registration of an Account and the use of services offered in the Service,
  • Establishing and maintaining contact with the User (including responding to inquiries),
  • Fulfilling the legal obligations of the Administrator (e.g., accounting, taxation),
  • Pursuing the Administrator’s legitimate interests (e.g., defending against potential claims),
  • Sending commercial or marketing information (with the User’s consent, if required).

The legal grounds for processing personal data include:

  • Article 6(1)(b) of the GDPR (performance of the Contract – use of the Service),
  • Article 6(1)(c) of the GDPR (fulfilling legal obligations),
  • Article 6(1)(f) of the GDPR (legitimate interests of the Administrator),
  • Article 6(1)(a) of the GDPR (consent) – e.g., for sending newsletters.

7. Liability and Disclaimer

  • The Administrator makes every effort to keep the Service available and functioning properly but does not guarantee uninterrupted, error-free usage of the Service.
  • The Service is provided “as is,” and the Administrator shall not be liable for indirect, secondary, incidental, or consequential damages arising from the use (or inability to use) the Service.
  • The User bears full responsibility for all actions taken in the Service using their Account, including any legal violations or damages caused to third parties.

8. Termination of the Contract and Account Deletion

  • The User may cease using the Service at any time by discontinuing its use or by requesting the deletion of their Account. Account deletion is performed by contacting the Administrator (e.g., via email at [email protected]).
  • The Administrator may terminate the Contract or suspend the User’s Account with immediate effect if the User is found to have violated these Terms, legal regulations, or other significant terms (e.g., endangering the security of other Users).

9. Changes to the Terms

  • The Administrator reserves the right to make changes to these Terms for valid reasons, in particular if required by changes to legal regulations, organizational changes, or expansion of the Service’s functionalities.
  • The User will be informed of the proposed changes at least 30 days in advance (e.g., via a notice on the Service or by sending an email to the address associated with the User’s Account).

10. Final Provisions

  • These Terms come into force on January 8, 2025, and shall remain in effect until revoked or replaced by new terms of service.
  • In matters not regulated by these Terms, the relevant provisions of Polish law shall apply, and any disputes shall be resolved by the competent common courts in Poland.
  • Any invalid or unenforceable provisions of these Terms shall not affect the validity and enforceability of the remaining provisions.
  • Effective date: January 8, 2025.
